Juiced Products is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service ("Terms") govern your use of the Services. By visiting, interacting with, using our Services, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use or access the Services.

Your order is not accepted until confirmed by Juiced Products. We must receive and process payment before an order is accepted.
We may be unable to accommodate cancellation requests after an order is accepted, processed, or shipped.
If we cancel or modify an order, we will attempt to notify you using the contact information provided at checkout.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
You represent that your purchases are for lawful use and not for unauthorized resale, export, fraud, or misuse.

SECTION 7 - SHIPPING AND DELIVERY
Shipping and delivery dates are estimates only and are not guaranteed. We are not liable for shipping or delivery delays caused by carriers, suppliers, customs processing, weather, labor interruptions, incorrect addresses, or events outside our control.
Once products are transferred to the carrier, title and risk of loss pass to you to the fullest extent permitted by law.
Shipping issues are also governed by our Shipping Policy, if posted separately on the Services.

All returns, refunds, cancellations, and exchanges are governed by our Refund Policy.

SECTION 13 - RELATIONSHIP WITH SHOPIFY
Juiced Products is powered by Shopify. However, all sales and purchases made through our store are made directly with Juiced Products.
By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Juiced Products, including injury, damage, loss, refund issue, warranty claim, or product-related dispute. You release Shopify and its affiliates from claims arising from or related to your purchases and transactions with Juiced Products.

SECTION 14 - PRIVACY POLICY
All personal information collected through the Services is subject to our Privacy Policy.
Because the Services are hosted by Shopify, Shopify may collect and process personal information about your access to and use of the Services. Information you submit may be transmitted to Shopify and third-party service providers as necessary to operate the store, process payments, ship products, and provide customer service.

No bot, crawler, scraper, AI agent, automated tool, or similar software may access or interact with the Services unless it clearly identifies itself and complies with all technical restrictions, robots.txt instructions, access controls, and security measures.
Automated systems may not conceal identity, mimic human behavior to bypass controls, complete or circumvent CAPTCHAs, or avoid measures intended to control automated access.
We may restrict, block, or limit automated access at any time.

SECTION 19 - CHARGEBACKS AND FRAUD PREVENTION
Before initiating a chargeback, payment dispute, or fraud claim, you agree to contact us at orders@juicedproducts.com and allow reasonable time for review and resolution.
We reserve the right to contest chargebacks and submit order records, payment records, tracking information, delivery confirmation, communication logs, IP addresses, timestamps, fraud-screening data, and other relevant documentation to payment processors, banks, carriers, fraud prevention providers, or legal authorities.
We may cancel, delay, hold, or refund orders that appear suspicious, fraudulent, high-risk, or unverifiable.

SECTION 20 - TERMINATION
We may terminate this agreement or your access to the Services, in whole or in part, at any time without notice. You remain liable for all amounts due up to and including the date of termination.
Sections relating to intellectual property, feedback, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, privacy, and any provisions that by their nature should survive termination will continue to apply after termination.

SECTION 21 - DISCLAIMER OF WARRANTIES
The Services and all products are provided "as is" and "as available," except where expressly stated in our Warranty Policy or an applicable manufacturer warranty.

We do not guarantee that the Services will be uninterrupted, timely, secure, accurate, complete, or error-free.

To the fullest extent permitted by law, Juiced Products, its owners, partners, officers, employees, affiliates, agents, contractors, suppliers, service providers, licensors, Shopify, and Shopify affiliates shall not be liable for any injury, loss, claim, or direct, indirect, incidental, punitive, special, consequential, or similar damages, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or property damage arising from your use of the Services or products purchased through the Services.
This limitation applies whether based in contract, tort, negligence, strict liability, warranty, statute, or otherwise, even if advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless Juiced Products, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, suppliers, and service providers from losses, damages, liabilities, claims, demands, judgments, settlements, costs, or expenses, including reasonable attorneys' fees, arising from: (1) your breach of these Terms or incorporated policies; (2) your violation of law or third-party rights; (3) your misuse of the Services or products; or (4) your submitted content or Feedback.

Nothing in these Terms is intended to limit rights that cannot be waived under applicable law.
If you are a California resident, European Union resident, United Kingdom resident, or resident of another jurisdiction with mandatory consumer protection laws, you may have additional rights under applicable law. These Terms apply only to the maximum extent permitted by such laws.
Where required by law, certain disclaimers, limitations of liability, arbitration provisions, or warranty exclusions may not apply to you.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed. The remaining provisions will remain valid and enforceable.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver.
These Terms, together with policies posted by us on the Services, constitute the entire agreement between you and Juiced Products and supersede prior or contemporaneous agreements, communications, and proposals, whether oral or written.

You may not delegate, transfer, or assign these Terms or any rights or obligations without our prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without notice or consent.

These Terms and any separate agreements whereby we provide Services shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to conflict of law principles.
Subject to the arbitration provisions below, you agree that any dispute arising from or relating to these Terms, the Services, or purchases made through the Services shall be brought in the state or federal courts located in Arizona, unless otherwise required by applicable law.

SECTION 29 - DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Informal Resolution Requirement
Before initiating any formal dispute, claim, arbitration, chargeback, or legal proceeding, you agree to first contact us at orders@juicedproducts.com and provide a written description of your issue, including relevant details and supporting documentation. You agree to allow us at least 30 days to attempt to resolve the dispute informally.

Agreement to Arbitrate
To the fullest extent permitted by law, you and Juiced Products agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, your account, communications with us, or any products purchased from us shall be resolved exclusively through final and binding arbitration, rather than in court, except as expressly provided below.

Arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator, and the arbitrator’s decision shall be final and binding.

Exceptions to Arbitration
Nothing in this section prevents either party from:
- Bringing an individual claim in small claims court, if eligible
- Seeking injunctive or equitable relief for intellectual property infringement, misuse, unauthorized access, fraud, or security violations

Class Action Waiver
You agree that any dispute resolution proceeding will be conducted only on an individual basis and not as part of any class, consolidated, collective, or representative action.
You expressly waive any right to participate in a class action lawsuit, class arbitration, private attorney general action, or other representative proceeding against Juiced Products.

Arbitration Location and Governing Law
Arbitration shall take place in Arizona, unless otherwise required by applicable law or agreed by both parties.
These Terms and any dispute shall be governed by Arizona law, without regard to conflict of law principles.

Fees and Costs
Each party shall be responsible for its own legal fees and costs unless otherwise required by applicable law or determined by the arbitrator. Arbitration filing, administrative, and arbitrator fees shall be allocated according to AAA rules.

Opt-Out Right
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to orders@juicedproducts.com. Your notice must include your full name, email address, and a clear statement that you wish to opt out of arbitration.
If you opt out, you will not be bound by this arbitration provision, but all other Terms will continue to apply.

Severability of Arbitration Clause
If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain in effect, except that if the class action waiver is found unenforceable, this entire arbitration section shall be null and void.

We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. Your continued use of or access to the Services after changes are posted constitutes acceptance of those changes.
